미국 상원 국토안보위원회, 생물보안법안 찬성 11, 반대 1로 통과

(전국= KTN) 김도형 기자= 한국바이오협회에 따르면 3월 6일, 미국 상원 국토안보위원회는 중국 BGI 및 Wuxi AppTec과 같은 중국 바이오기업과의 거래를 제한할 수 있는 법안을 11대 1로 통과시켰다고 밝혔다.

생물보안법(Biosecure Act)은 미국인의 개인 건강과 유전 정보를 우려기업으로부터 보호하기 위해 올해 1월말에 발의된 법안임. 미국 하원에서도 유사한 내용으로 발의된 상황이다.

이 법안이 최종 법으로 제정되기까지는 상원과 하원 전체회의를 통과한 후 대통령의 서명을 받아야 하는 등 시간이 걸리고 그 과정에서 상당한 수정이 있을 수 있지만, 이번 상원 국토안보위원회 통과는 중국 기업들이 미국이라는 중요한 시장에서 큰 제약을 받을 수 있다는 투자자들의 우려를 불러올 수 있다.

WuxiAppTec은 매출의 절반 이상을 미국에서 창출하고 있으며 조지아, 펜실베니아 및 캘리포니아를 포함한 미국 전역에서 시설을 운영하고 있으며 델라웨어에 추가로 새로운 캠퍼스를 개설할 예정이다. 법안의 내용은 미국 연방기관이 중국의 BGI와 그 계열사인 MGI 및 Complete Genomics, Wuxi AppTec과 그 계열사인 Wuxi Biologics 등과 같은 우려대상 바이오기업과 계약하는 금지하고 있으며, 이들 우려기업들의 장비나 서비스를 사용하는 회사들과의 계약 체결도 금지하는 것이다.

한국바이오협회는 법안이 통과될 경우 미국 내에서 바이오산업과 같은 중요한 분야에 외국 특정기업의 개입을 엄격하게 통제하는 새로운 시대가 열리게 되고, 국제적으로도 미국이 지명한 이들 우려기업들과의 거래 및 파트너십에 영향을 미치는 등 광범위한 변화를 불러일으킬 것으로 전망된다고 밝혔다. 

한편, 바이든 대통령은 2월 28일 유전체, 생체인식 및 건강 데이터 등의 미국인 민감정보가 우려 국가로 대량 이전되는 것을 규제하기 위한 행정명령에 서명함으로써 중국, 러시아 등 우려국가의 관련기업들이 미국에서 영업하고 기업간 전략적 제휴 체결을 하는데 직접적인 영향을 받게 될 것으로 예상된다.

U.S. Senate Homeland Security Committee Passes Biosecurity Bill 11 in favor, 1 in opposition

(National = KTN) Reporter Kim Do-hyung = According to the Korea Bio Association, the U.S. Senate Homeland Security Committee on March 6 announced that it had passed a bill 11-1 to restrict transactions with Chinese biotech companies such as China's BGI and Wuxi AppTec.

The Biosecure Act was introduced at the end of January this year to protect Americans' personal health and genetic information from companies of concern. The U.S. House of Representatives also proposed a similar bill.

Although it takes time for the bill to become a final law and there could be significant revisions in the process, such as having to pass the Senate and House plenary sessions and having to be signed by the president, the passage of the Senate Homeland Security Committee could raise investor concerns that Chinese companies could be heavily constrained in the important market of the United States.

WuxiAppTec generates more than half of its sales in the U.S., operates facilities across the U.S., including Georgia, Pennsylvania and California, and plans to open additional new campuses in Delaware. The bill prohibits U.S. federal agencies from signing contracts with concerned bio companies such as China's BGI, its affiliates MGI and Complete Genomics, and Wuxi AppTec and its affiliates Wuxi Biologics.

The Korea Bio Association said the bill is expected to open a new era of strict control over the intervention of specific foreign companies in important areas such as the bio industry in the United States, and it will affect transactions and partnerships with these U.S.-appointed companies internationally.

Meanwhile, President Biden signed an executive order on Feb. 28 to regulate the mass transfer of American sensitive information such as genomes, biometrics and health data to countries of concern, which is expected to directly affect companies involved in countries such as China and Russia operating in the U.S. and signing strategic alliances between companies.
