[한국유통신문= 김도형 기자] 통일교 한학자 총재가 정치자금법 위반 등 혐의와 관련해 22일 밤 구속됐다. 서울중앙지법 정재욱 영장전담 부장판사는 이날 구속 전 피의자 심문(영장실질심사)을 거쳐 “증거 인멸 우려가 있다”며 구속영장을 발부했다.

반면 정원주 전 비서실장에 대해선 “혐의 소명의 정도가 충분하지 않고 방어권 보장 필요성이 크다”며 구속영장을 기각했다. 정 부장판사는 “공범일 가능성을 배제할 순 없으나 현 단계에서 증거만으로는 구속 사유가 충분하지 않다”고 설명했다.

통일교는 이날 밤 즉각 입장을 내고 “법원의 결정을 겸허히 받아들이며 향후 수사와 재판 절차에 성실히 임하겠다”며 “교단이 신뢰를 회복할 수 있도록 최선을 다하겠다. 국민 여러분께 심려를 끼친 점에 깊이 사과드린다”고 밝혔다.

한 총재는 구속 심사 과정에서 “정치에는 관심이 없고 잘 알지 못한다”며 도주 및 증거 인멸 가능성을 부인했으나, 재판부는 특검이 제출한 약 420여 쪽 의견서와 220여 쪽 분량 자료 등을 근거로 구속 필요성을 인정한 것으로 전해졌다.

특검팀은 한 총재에게 정치자금법 위반·청탁금지법 위반·업무상 횡령·증거인멸교사 등의 혐의를 적용하고 있다. 수사팀은 한 총재가 2022년 4~7월 간 통일교 관계자를 통해 외부 인사에게 금품을 제공했으며, 같은 해 초 특정 정치인과 정당에 정치자금을 전달한 정황이 있다고 보고 있다.

또한 원정 도박 의혹과 관련해 측근에게 증거 인멸을 지시한 혐의도 수사 대상에 포함됐다.

이번 구속으로 종교계 인사가 현 특검 수사에서 법원의 판단을 통해 구속되는 첫 사례가 됐다. 향후 본격 재판 과정에서 사실관계와 법적 책임 여부가 구체적으로 가려질 전망이다.

On the other hand, Jung Won-joo, the former chief of staff, rejected the arrest warrant, saying, "There is not enough explanation for the charges and there is a great need to guarantee the right to defend." Jeong explained, "We cannot rule out the possibility of a criminal offense, but at this stage, evidence alone is not enough to warrant arrest."

"We humbly accept the court's decision and will faithfully engage in future investigations and trial procedures," the Unification Church said in a statement. "We will do our best to help the church regain trust. We deeply apologize for causing concern to the people."

Governor Han denied the possibility of fleeing and destroying evidence, saying, "I am not interested in politics and I am not familiar with it," during the arrest review process, but the court reportedly admitted the need for arrest based on about 420 pages of opinion and 220 pages of data submitted by the special prosecutor.

The special prosecution team is charging Han with violating the Political Fund Act, violating the Solicitation Prohibition Act, embezzlement on the job, and destroying evidence. The investigation team believes that Han provided money and valuables to outside people through officials of the Unification Church between April and July 2022, and that he delivered political funds to specific politicians and political parties early in the same year.

Also included in the investigation was the charge of ordering a close aide to destroy evidence in connection with the alleged away gambling.

This arrest marks the first time that a religious figure has been arrested through the judgment of the court in the current special prosecution investigation. It is expected that the facts and legal responsibility will be specifically determined during the full-fledged trial in the future.
