제9회 유럽종교학회 연례 국제학술대회서 인권·종교 자유 문제 거론…“신속한 재검토 필요”

유럽의 종교사회학자와 인권·종교자유 활동가들이 이탈리아 로마에서 열린 국제학술대회에서 한국의 95세 고령 종교지도자 구금 문제를 거론하며 인도적 조치와 신속한 재검토를 촉구했다.

제9회 유럽종교학회(European Academy of Religion·EuARe) 연례 국제학술대회가 지난 3일 현지시간 이탈리아 로마에서 열린 가운데, 참석자들은 고령 피고인의 구금 적절성과 인간 존엄성, 종교 자유 및 국제 인권 기준 등을 중심으로 의견을 밝혔다.

세계신흥종교연구소(CESNUR) 대표이자 종교사회학자인 마시모 인트로비녜 박사는 유럽의 고령 수용자 처우 기준을 언급하며 한국 당국의 조치를 비판했다.

인트로비녜 박사는 “유럽연합 회원국에서는 법률에 따라 80세 이상인 사람은 매우 예외적인 경우에만 수감될 수 있으며, 필요한 경우 가택연금이 적용돼야 한다”고 주장했다.

이어 “구금은 폭력이나 살인 등 중범죄 위험이 있을 때에만 이뤄져야 하지만, 이 사건의 혐의는 정당법 위반”이라며 “한국이 이 고령의 종교지도자에게 취하고 있는 처우는 유엔의 ‘만델라 규칙’을 포함한 국제 인권 기준에 어긋난다”고 말했다.

 

 

 

 

 

 

 

유엔이 채택한 ‘넬슨 만델라 규칙’은 수용자 처우에 관한 국제적 최소 기준을 담은 규범이다. 다만 구체적인 사건에 해당 규칙이 어떻게 적용되는지는 당사자의 건강 상태와 구금 필요성, 국내 법원의 판단 등을 종합적으로 검토해야 한다.

유럽종교간포럼(EIFRF) 대표이자 종교 간 대화 활동가인 에릭 루 대표는 고령자의 구금과 인간 존엄성의 조화를 강조했다.

에릭 루 대표는 “‘95세 고령자 수감’과 ‘인간의 존엄성 존중’은 양립하기 어렵다”며 “설령 제기된 혐의가 사실이라고 하더라도 이 나이의 사람을 구금하는 것이 적절한지 재검토해야 한다”고 밝혔다.

그는 “이 사안이 한국의 국제적 명예에 악영향을 미치지 않도록 신속히 판단해야 한다”며 즉각적인 석방을 촉구했다.

유럽신앙자유연맹(FOB) 의장이자 영국 상급법원 사무변호사인 알레산드로 아미카렐리 변호사도 한국의 인권 상황에 대한 우려를 나타냈다.

아미카렐리 변호사는 “대한민국을 인권이 존중되는 민주국가로 여겨 왔지만, 민주주의 국가에서 95세 종교지도자가 이 같은 압박을 받는 상황은 충격적”이라고 말했다.

이어 “대한민국이 헌법과 인권의 기본 원칙에서 벗어나고 있는 것은 아닌지 우려된다”며 “신천지가 부당하다고 주장하는 탄압과 박해에 맞서는 과정에 연대하겠다”고 밝혔다.

이날 발언들은 고령 종교지도자에 대한 구금 필요성과 상당성, 건강권과 인간 존엄성 보장, 종교단체에 대한 수사 과정의 적법성 등을 국제 인권의 관점에서 재검토해야 한다는 데 초점이 맞춰졌다.

다만 해당 인사들의 발언은 학술대회 참석자 개인 또는 소속 단체의 입장으로, 구체적인 혐의의 성립 여부와 구속의 적법성은 한국 사법기관의 증거 판단과 법적 절차에 따라 결정된다. 관계 당국의 입장과 재판 진행 상황을 함께 확인할 필요가 있다.

 

European religious and human rights experts raise concerns about detention of elderly religious leaders in South Korea at international conference in Rome

European religious sociologists and human rights and religious freedom activists have called for humanitarian action and prompt review, citing the detention of 95-year-old religious leaders in South Korea at an international academic conference in Rome, Italy.

While the 9th European Academy of Religion (EuARe) annual international academic conference was held in Rome, Italy, on the 3rd local time, participants expressed their opinions focusing on the appropriateness of the detention of elderly defendants, human dignity, religious freedom and international human rights standards.

Dr. Masimo Introvigne, head of the World Institute of Emerging Religion (CESNUR) and religious sociologist, criticized the Korean authorities' actions, referring to the standards for treating elderly prisoners in Europe.

"In EU member states, according to law, people over 80 can only be imprisoned in very exceptional cases, and house arrest should be applied if necessary," Dr. Introvigne argued.

"Arrest should only be carried out when there is a risk of a serious crime such as violence or murder, but the charges in this case violate the party law," he said. "The treatment South Korea is taking against this elderly religious leader goes against international human rights standards, including the U.N.'s Mandela Rule."

The Nelson Mandela Rule, adopted by the United Nations, is a norm that contains international minimum standards for the treatment of prisoners. However, how the rule applies to specific cases should comprehensively examine the health condition of the person concerned, the need for detention, and the judgment of domestic courts.

Eric Lu, the head of the European Interfaith Forum (EIFRF) and an interfaith dialogue activist, emphasized the harmony between the detention of the elderly and human dignity.

"It is difficult to reconcile '95-year-old imprisonment' with 'respect for human dignity', CEO Eric Lu said. "Even if the charges raised are true, it is necessary to reconsider whether it is appropriate to detain a person of this age."

"We need to make a quick judgment so that this issue does not adversely affect Korea's international reputation," he said, calling for immediate release.

Alessandro Amicarelli, the president of the European Federation for Belief Freedom (FOB) and a British Superior Court clerical lawyer, also expressed concern about the human rights situation in Korea.

Attorney Amicarelli said, "Although South Korea has been regarded as a democratic country where human rights are respected, it is shocking that a 95-year-old religious leader is under such pressure in a democratic country."

"I am concerned that the Republic of Korea is deviating from the basic principles of the Constitution and human rights," he said. "I will stand in solidarity with the process of confronting the oppression and persecution that Shincheonji claims to be unfair."

The remarks focused on the need and relevance of detention of elderly religious leaders, the guarantee of health rights and human dignity, and the legality of the investigation process for religious organizations from the perspective of international human rights.

 

However, the remarks of the relevant persons are from the position of individual participants or affiliated organizations at the conference, and whether specific charges are established and the legality of arrest is determined by the evidence judgment and legal procedures of the Korean judicial institution. It is necessary to check the position of the relevant authorities and the progress of the trial together.
