[한국유통신문= 김도형 기자] 미국 국방부가 중국 군과 연계 의심 기업 목록을 연방관보에 제출했다가 철회하면서, 생물보안법 첫 '우려바이오기업' 명단 발표에 관심이 쏠리고 있다.

파이낸셜타임즈와 사우스차이나모닝포스트 등 해외 언론은 2026년 2월 13일 미국 국방부가 알리바바, 바이두, BYD, 우시앱텍(Wuxi Apptec) 등을 포함한 '중국 군사 기업(1260H)' 목록을 연방관보에 보냈다가 삭제했다고 보도했다. 국방부는 다음 주 새 명단 발표를 예고했으나 이유는 밝히지 않았다. 해당 기업들은 즉각 반발했고, 주미 중국대사관은 차별에 반대 입장을 밝혔다.

작년 12월 통과된 국방수권법 내 생물보안법은 우려바이오기업의 장비·서비스 조달·계약을 금지한다. 대상은 1260H 목록 기업, 외국 적대국 연계 바이오기관, 국가안보 위험 기업 및 계열사다. 관리예방국(OMB)은 발효 1년 내 명단 공표를 의무화해 2026년 12월 전 예상된다.

1260H 목록에 우시앱텍이 중국 정부·군(SASAC, SASTIND, PLA)과 간접 연계로 포함된 점이 주목된다. 최근 2년간 1월 발표 추세를 고려하면 2월 내 재발표 가능성이 크며, 이는 생물보안법 첫 규제 대상이 될 전망이다. 한국바이오협회 바이오경제연구센터는 거래·공급망 타격을 경고했다.

U.S. Biosecurity Law to Announce First Regulatory Targets

As the U.S. Department of Defense has submitted and withdrawn a list of suspected companies linked to the Chinese military to the Federal Register, attention is being paid to the announcement of the first "concerned bio-company" list of the Biosecurity Act.

Foreign media including the Financial Times and the South China Morning Post reported on Feb. 13, 2026, that the U.S. Department of Defense sent a list of "Chinese military enterprises (1260H)" including Alibaba, Baidu, BYD, and Wuxi Apptec to the Federal Register and deleted it. The Ministry of Defense announced the announcement of the new list next week, but did not give a reason. The companies immediately protested, and the Chinese Embassy in the U.S. expressed opposition to discrimination.

The Biosecurity Act within the National Defense Authorization Act, which was passed in December last year, prohibits bio companies of concern from procuring equipment and services or contracting. The targets are companies listed on the 1260H list, bio organizations linked to foreign hostile countries, companies at risk of national security, and affiliates. The Office of Management and Prevention (OMB) is expected to announce the list within one year after its effectuation, which is expected to be before December 2026.

It is noteworthy that Wuxi Apptech is included in the 1260H list as an indirect link with the Chinese government and military (SASAC, SASTIND, PLA). Considering the trend of January announcements over the past two years, there is a high possibility that they will be re-issued within February, which is expected to be the first subject of regulation under the Biosecurity Act. The Bioeconomic Research Center of the Korea Bio Association warned of a trade and supply chain hit.
