범죄 피해자의 트라우마 극복과 피해자 입장이 반영되는 형사절차

Criminal procedure that reflects the victim's position and overcoming trauma of crime victims.

(전국= KTN) 김도형 기자= 구미경찰서(서장 이갑수)에서는 지난 31일 특수상해, 특수협박 등 피해자 2명에 대해 도내에서 처음으로 범죄 피해 평가제를 시행했다고 9월 3일 밝혔다.

범죄 피해 평가제란 경찰관과 심리전문가가 공동으로 피해자 면담과 심리검사를 통해 피해상황을 종합적·객관적으로 파악하여, 평가 보고서를 수사서류에 편철함으로써 재판에 이르기까지 피해자의 입장이 충분히 반영될 수 있도록 하는 새로 도입된 형사 절차의 하나이다.

그간 강도, 데이트 폭력, 성 범죄 등 강력범죄 피해자 대부분이 심각한 정신적·사회적 고통을 경험하지만 실질적으로 그들의 입장을 형사절차에 반영하는 제도적 장치는 미흡했다.

The crime damage assessment system is a newly introduced criminal procedure in which police officers and psychologists jointly identify the damage situation comprehensively and objectively through victim interviews and psychological tests, and compile an evaluation report into investigation documents so that the victim's position can be fully reflected until the trial.

Until now, most victims of violent crimes such as robbery, dating violence, and sex crimes have experienced serious mental and social pain, but there has been a lack of institutional mechanisms that actually reflect their positions in criminal procedures.

피해자의 대인기피증, 자살 시도 등 강력범죄 뒤에 남은 정신적 폐해(트라우마)가 심각했음에도 사회적 관심과 대응은 잔걸음 수준이었다.

또, 수사와 재판에 있어서도 피해자들의 진술권이 보장되어 있으나 피해상황을 조서로 나타내기에는 한계가 있을 수밖에 없고, 증인으로서 법정에서의 진술 역시 출석 자체가 부담일 수밖에 없는 상황이다.

피해 평가제는 이와 같은 상황을 고려하여 피해자의 신체적·정신적·경제적 피해가 어느 정도인지, 범죄 이후 직장생활 등 대인관계는 어떤지, 2차 피해 가능성은 없는지 등에 대해 면밀히 조사한다.

Despite the serious trauma left after violent crimes such as anti-popularism and suicide attempts by victims, social attention and response were at a snail's pace.

In addition, the victims' right to statement is guaranteed in investigation and trial, but there is a limit to expressing the damage in a report, and the court's statement as a witness is also a burden on their attendance.

Considering this situation, the damage assessment system closely examines the extent of the victim's physical, mental and economic damage, how much interpersonal relationships such as working life after the crime, and whether there is a possibility of secondary damage.

조사 결과에 따라 피해자의 동의를 받아 심리상담이나 생활비·치료비 지원도 가능하며 신변보호 등 조치도 병행할 수 있다.  

이갑수 경찰서장은 범죄 피해 평가제를 통해 2차 피해를 방지하고, 피해자의 입장이 반영되는 균형감 있는 형사절차가 진행될 수 있도록 적극 노력하겠다고 밝혔다. 
 

한편, 구미경찰서는 피해자 지원을 위한 특수시책으로 지난 8월 6일 대한적십자사 경북지사와 업무협약을 체결하고, 경찰관들이 자발적으로 모금한 피해자지원 기금 780여만원을 기탁 운영하고 있다.

Police chief Lee Kap-soo said, "We will actively make efforts to prevent secondary damage through the crime damage assessment system and to ensure that balanced criminal procedures that reflect the victim's position can proceed."

Meanwhile, Gumi Police Station signed a business agreement with the Gyeongbuk Governor of the Korean National Red Cross on August 6 as a special measure to support the victims, and is operating a fund of 7.8 million won that police officers voluntarily raised.
